What we do

If no one becomes involved and helps the Rescue Centers, the horses lose!
Lost Path Stables, (501c3 non-profit) is asking for your assistance financially and actively participating in the pursuit of justice for our equines.
Equines defined as Horses, Mules, and Donkeys.
No person shall deprive any animal over which the person has charge or control of necessary food, water, or shelter!
You say, "I don't want to get involved." People need to know this is a worthy mission to show a United Front. The horses need to be protected. When we are Divided, the horses suffer, and many will die!
Please take a stand and support this case.
This one case, can set a precedence for all others
It is our intent to make the Public aware of what their options are before the animal is starved or abandoned, thus resulting in the safety of the animal or arrest of neglector.
The General Public or, in this case the Person Involved in Neglecting the Horses, must be sure as to take care of the Horses, selling, giving away, releasing or to put down the Horses, before starvation.
If the Horse Industry does not get involved, the end result will be no Rescue Centers available when the
need is urgent!
LOST PATH STABLES GOAL:
Lost Path Stables will set a precedence for our legal system to follow.
Our Intent is to address the Koochiching County Attorney and Sheriff's Department.
They will be informed that Lost Path Stables, will not allow them to ignore the law, as to the reimbursement
for their Rescue Centers.
Lost Path Stables, the Horses who were rescued, and Horses in the future who may Need a Rescue Center, ask for your Monetary, Active and Heartfelt support.

The Process

Under Minnesota Statutes 343.29 ' In all cases, the owner, if known, shall be immediately notified as provided in section 343.235 subdivsions 3, and the person having possession of the animal, shall have lien therein for its actual costs of care and keeping and the expenses of the notice. If the owner or custodian is unknown and cannot by reasonable effort be ascertained, or does not, within ten days after notice, redeem the animal by paying the expenses authorized by this subdivision, the animal may be disposed of as provided in section 343.235'.

Under Minnesota Statutes 343.235 Subd.3b. Upon request of a person claiming in the animal, which request must be made within ten days of the date of seizure, a hearing must be held within five business days of the request, to determine the validity of the seizure and impoundment. If the seizure was done pursuant to a warrant under section 343.22, the hearing must be conducted by the judge who issued the warrant. If the seizure was don't under section 343.12, 343.29, or 343.31, the municipality taking custody of the animal or, in the case of a humane society, the municipality from which the animal was seized, may either (1) authorize a licensed veterinarian with no financial interest in the matter or professional association with either party or (2) use the services of a hearing officer to conduct the hearing. A person claiming an interest in the animal who is aggrieved by a decision of a hearing officer under this subdivision may seek a court order governing the seizure or impoundment within five days of notice of the order. (d) The person claiming an interest in the animal is liable for all actual costs of care, keeping, and disposal of the animal, except to the extent that a court or hearing officer finds that the seizure or impoundment was not substantially justified by law. The costs must be paid in full or a mutually satisfactory arrangement for payment must be made between the municipality and the person claiming an interest in the animal before return of the animal to the person.

Minnesota Statutes 343.21 Subd. 10. RESTRICTIONS. If a person is convicted of violating this section, the court shall require that pet or companion animals that have not been seized by a peace officer or agent and are in the custody or control of the person must be turned over to a peace officer or other appropriate officer or agent unless the court determines that the person is able and fit to provide adequately for an animal.--The court may limit the persons further possession or custody of pet or companion animals, and may impose other conditions the court considers appropriate, including but not limited to: 1. imposing a probation period during which the person may not have ownership, custody, or control of a pet or companion animal. 2. requiring periodic visits of the person by an animal control officer or agent appointed pursuant to section 343.01 subd. 1. 3. requiring performance by the person of community service; and 4. requiring the person to receive psychological. behavioral, or other counseling.

343.23 Minnesota Statutes. The expenses of the investigation authorized by section 343.22 including the fee of the doctor of veterinary medicine, the expenses of keeping or disposing of any animal taken into custody pursuant to an investigation, and all other expenses reasonably incident to the investigation shall be paid by the county treasurer from the general fund of the county. If the person alleged to have violated section 343.21 is found guilty of the violation, the county shall have judgment against the guilty person for the amount of the expenses.

There is a charge of $35 a day per horse (mares and geldings), $40 a day (stallions, Mares with foal or in foal).

This amount is to be paid to the rescue facility chosen by the county or humane society. The charges will be collected from the neglector. If the neglector cannot or will not pay the county is then responsible to pay.

Should the animal be reported to us as being neglected or abused, that animals local humane society or sheriffs office will be notified and due process will be followed.
